Terms of service

1. Who provides the service

GymSmartAccess is a software-as-a-service (SaaS) platform, developed and operated from Corrientes, Argentina, for running gyms and fitness studios: access control, collecting membership fees and managing members.

2. Accepting these terms

Using the platform means accepting these terms. If you do not agree with any part of them, do not use the service.

GymSmartAccess may change these terms. We will tell you about any significant change through the platform or by email at least 15 days before it takes effect; continuing to use the service after that date means accepting the new terms.

3. The service

The platform includes, among other features:

  • Managing members, their plans and their payments
  • Access control at each location: with the location’s QR code, its 6-digit code or recorded at the front desk, according to whether each member is up to date with their fees
  • Several locations, with a team that has roles and assigned locations
  • Classes, their capacity and members’ bookings
  • The member app, to see one’s plan and get in
  • Reports, metrics and notices
  • A public page for each gym

Charging members online depends on the gym’s country and the payment methods available there.

4. Your account

Using the service requires an account with true, complete and up-to-date information. The account holder is responsible for keeping their credentials confidential and for whatever is done with them.

The gym is responsible for the data it enters about its members and its team, and for having a legal basis to do so, including a parent’s or guardian’s consent where a member is a minor. GymSmartAccess may suspend or close an account with false information or that breaches these terms.

5. Plans and payment

GymSmartAccess offers plans with different features and limits, published on Pricing. Outside Argentina, prices are in US dollars (USD), and you sign up by talking to our team.

The plan is paid by bank transfer, arranged with us, or by card through our payment provider once it is available in your country. If a payment does not go through, the service may be suspended until it is settled.

We may change the prices of the plans with at least 30 days’ notice. The change applies from the next billing period.

6. Your obligations

Anyone using the platform agrees to:

  • Use it in accordance with applicable law
  • Not use it for unlawful or fraudulent purposes, or in a way that infringes others’ rights
  • Not try to access other gyms’ or people’s systems, data or information without authorization
  • Not reverse engineer, decompile or try to obtain the software’s source code
  • Keep the information of their account and their members up to date
  • Comply with the data protection law that applies to their members’ data

7. Intellectual property

All intellectual property rights in the platform, including the software, design, trademarks, logos, texts and images, belong to GymSmartAccess or its licensors. A subscription grants a limited, non-exclusive, non-transferable and revocable license to use the platform under these terms, and transfers no intellectual property right.

The data a gym enters belongs to the gym.

8. Data protection

For its members’ data, the gym is the controller and GymSmartAccess is its processor, acting on the gym’s instructions. The details are in our Privacy policy.

9. Availability

GymSmartAccess makes its best efforts to keep the platform available 24 hours a day, 7 days a week, but does not guarantee uninterrupted service and is not liable for interruptions caused by scheduled maintenance, force majeure or causes beyond its control.

10. Limitation of liability

To the extent the applicable law allows, GymSmartAccess is not liable for indirect, incidental, special or consequential damages, including loss of data, lost profits or business interruption. Its total aggregate liability does not exceed what the gym paid for the service in the last 12 months.

11. Cancellation

The gym may cancel its plan at any time, from its subscription screen or by telling us. It keeps the service until the end of the period already paid, with no prorated refund unless the applicable law provides otherwise.

GymSmartAccess may close an account that breaches these terms with 15 days’ notice, unless a serious breach justifies closing it immediately.

12. Governing law and courts

These terms are governed by the laws of the Argentine Republic, and the parties submit to the Ordinary Courts of the Autonomous City of Buenos Aires. Nothing in these terms limits the mandatory rights the law of the country where you live gives you as a consumer or as a data subject, including the GDPR.
